Averboomfritz.com operates as the selling platform for the artist Alexandra Verboom Fritz for the sale of fine art (hereinafter referred to as “goods”) at averboomfritz.com (hereinafter “website”).
The business relationship between Averboomfritz.com and the ordering party shall exclusively be governed by the following Terms and Conditions, as amended when the order is placed. These Terms and Conditions shall form an integral part of each contract concluded with Averboomfritz.com. With the placement of the order the ordering party agrees with these Terms and Conditions and accepts to be bound by them.
Goods
The goods will be produced only after placement of and according to the order of the ordering party. With the placement of the order, the ordering party expressly acknowledges that the quality of the goods depends on the material specified on the website and that due to the production, photographic, and printing methods, minor variations in colour and format may occur compared to the samples displayed on the website. With the placement of the order, the ordering party also acknowledges that the goods will inevitably be subject to a product-specific and natural change (e.g. bleaching) which may be accelerated by environmental impacts and inappropriate storage or care. These minor variations and/or these changes do not affect the fact that the goods are consistent with the terms of the contract and do not render the goods defective.
Prices
Unless otherwise stated, prices indicated for the goods are the list price plus shipping costs.
Conclusion of Contract and Delivery
The presentation by Averboomfritz.com of goods on its website or elsewhere shall not constitute an offer for sale, but shall be deemed an invitation to the ordering party to submit a purchase offer. Averboomfritz.com does not warrant that the goods presents are ready for delivery at any time, due to sales at other events and on other platforms. Offers to buy shall be submitted online, using the purchase form made available on the website. The ordering party will receive confirmation of receipt of the order within 24 hours. Should the item(s) ordered be unavailable Averboomfritz.com will notify the ordering party and issue a reimbursement within 24 hours.
The ordering party is obliged to provide the information requested in the purchase form truthfully and completely. Any damage or fees caused by false or incomplete information shall be reimbursed by the ordering party. Orders are accepted only from persons who are of age and only at the current prices and terms indicated on the website.
The ordering party will receive confirmation of receipt of the order within 24 hours and the order will be shipped within 5 business days. A tracking number and a notice of shipment will be supplied to the ordering party on the day of shipment. Orders are shipped via Canada Post, Purolator or FedEx to Canadian addresses. For international orders please email us at averboompainting@gmail.com for shipping information. Averboomfritz.com is not responsible for any delays relating to shipment after the parcel has been submitted to the currier.
Payment
Payment of the purchase price shall be made on the website or through the invoice emailed to the customer processed by PayPal or Square.
Right of Rescission
The ordering party may request to rescind goods received by contacting Averboomfritz.com directly at averboompainting@gmail.com
Warranty & Liability
Warranty of Goods:
For specific product defects and warranty enquirers please contact Averboomfritz.com directly, explaining the defect and submitting photos of the product to averboompainting@gmail.com
Shipping Liability:
Should the goods be defective upon their arrival at the ordering party despite protective packaging, the ordering party shall promptly notify Averboomfritz.com. Defective GOODS shall be returned to Averboomfritz.com in the original packaging at the expense of Averboomfritz.com. The ordering party may choose to receive a replacement product at equal value or receive a full reimbursement.
Liability:
Averboomfritz.com Is not liable for either technical failures during the operation of the website, or for any content on the website or on hyperlinked websites, or for damage caused by having visited the website or any of the hyperlinked websites.
Copyright
The goods sold by Averboomfritz.com are protected by copyright worldwide and are made available to the ordering party for their personal use and resale only. The ordering party shall not reproduce, make available to the public in any form of distribution by third parties. The same applies also to the website and its contents.
Data Privacy
With the placement of the order, the ordering party expressly agrees that Averboomfritz.com will use the ordering party’s name, address, phone number, and e-mail address as well as its previous orders to process the relevant order. This data will be disclosed to third parties only to the extent necessary for the processing of the order, (i.e. the carrier or the postal service).
